§ 1 Scope

These General Terms and Conditions apply to all contracts concluded between Lars Dietzel (hereinafter "Provider") and the customer for the purchase of digital content on the platform 10x-aero.com. They apply to customers who are consumers within the meaning of § 13 of the German Civil Code (BGB).

§ 3 Services

The Provider offers digital learning guides (hereinafter "Guides") in electronic form, together with associated design files. The Provider reserves the right to make changes and improvements to the content.

§ 4 Conclusion of Contract

The presentation of products on the website does not constitute a legally binding offer. By completing the checkout and clicking the payment button, the customer makes a binding offer to purchase. The contract is concluded when the Provider confirms the order or grants access to the purchased Guide.

§ 5 Prices and Payment

All prices are final prices in euros. Statutory VAT is calculated and shown at checkout. Payment is processed by our payment service provider Stripe. The purchase amount is due upon conclusion of the contract.

§ 6 Right of Withdrawal and Voluntary Money-Back Guarantee

Consumers are generally entitled to a statutory 14-day right of withdrawal. For digital content not supplied on a tangible medium, this right expires once the Provider has begun providing the content after the consumer has (i) expressly consented to the Provider beginning before the end of the withdrawal period and (ii) confirmed their acknowledgment that they thereby lose their right of withdrawal (§ 356(5) BGB; Art. 16(m) Directive 2011/83/EU). The customer gives this consent and acknowledgment during checkout, and the Provider confirms it on a durable medium together with the order. As access is granted immediately, the statutory right of withdrawal will, as a rule, no longer apply. Full details and the model withdrawal form are set out in our Cancellation Policy.

Independently of the statutory right of withdrawal, the Provider voluntarily grants a 30-day money-back guarantee. A customer who is not satisfied may, within 30 days of purchase, request a full refund by email; access to the Guide will then be revoked. This voluntary guarantee is granted in addition to, and does not restrict, the customer’s statutory rights.

§ 7 License and Usage Rights

Upon purchase, the customer receives a simple, non-exclusive, non-transferable license to use the Guide and the accompanying design files for their own purposes, including professional and commercial engineering work. In particular, the customer may use the knowledge, techniques, and design files to design, build, manufacture, and sell their own products, including products derived from or based on the design files.

The license does not permit the customer to redistribute, share, publish, resell, sublicense, or otherwise make the Guide or the design files themselves available to third parties (in whole or in substantial part), whether free of charge or for payment, nor to present them as the customer’s own work. The customer may also not manufacture the Provider’s design substantially unchanged for the primary purpose of reselling it as a stand-alone product that competes with the Guide; this does not restrict the customer from building such boards for their own use or from creating and selling their own derived designs.

References to "lifetime" or "lifetime access" mean access for as long as the Provider operates the relevant Guide on the 10x-aero.com platform. They do not denote a fixed period of time or guarantee perpetual availability. The Provider may discontinue a Guide or the platform; where reasonably possible, the Provider will give advance notice and, where appropriate, an opportunity to download the purchased content.

§ 8 Limitation of Liability

The Provider shall be liable without limitation for damages arising from injury to life, body or health, for damages based on intent or gross negligence, for fraudulently concealed defects, and under the German Product Liability Act. In the case of slight negligence, the Provider shall only be liable for the breach of an essential contractual obligation (cardinal obligation) — an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance the customer may regularly rely; in such cases liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

The Guides provide general technical information and do not constitute professional, safety, or engineering advice. The customer is responsible for independently verifying any designs or decisions before relying on them.

§ 9 Governing Law and Jurisdiction

These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Where the customer is a consumer, this choice of law does not deprive the consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence. The statutory places of jurisdiction apply.

§ 10 Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of § 36 of the German Consumer Dispute Resolution Act (VSBG).

§ 11 Severability

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
